Show Boundary Comsrsnissiora Scabies jraeranerfiors request The Uintah County Boundary Commission tabled action on the Pike-Countryside Pike-Countryside Annexation while attornies argue the validity of the annexation, only to be met with three other annexation an-nexation petitions this week. The seven-member commission met last Thursday to make a ruling on the Pike annexation which requests that 201 acres at 500 South 1000 West from Highway 40 to 2100 West come into the city. About 50 people in the Pike annexation an-nexation were present at the meeting, the majority were in support of the annexation. Dave Burningham, Vernal City attorney, at-torney, summorized the city's position on the annexation saying that the commission should not attempt to determine the financial responsibility of the residents in the annexation to the Ashley Valley Water and Sewer Improvement Im-provement District, (AVWSID) which began sewer construction in the annexation an-nexation since the time the annexation was filed with the city. In March of 1980 Vernal City adopted its growth policy declaration which was prior to the district making sewer plans for the contested area, Burmingham Mark Nash and Ray Nash, representing AVWSID, contended that the situation in the Pike-Countryside annexation is similar to the Taylor-Washburn Taylor-Washburn Annexation and the rulings should be consistent. Last spring the commission ruled that the Taylor-Washburn annexation, south on 500 West, could come into the city, but the residents were to pay the AVWSID sewer connection and maintenance fees. The two attornies pointed out that the annexation may be improper if the AVWSID had obtained the names of 30 people who withdraw their names from the annexation petition. There is also a petition to withdraw names from the AVWSID, said Bob Nickolson, Boundary Commission secretary, this week. Orlo Goodrich, Boundary Commission Com-mission member, made a motion that a decision on the annexation be tabled until Sept. 3, 1981 so the attorneys for each side could meet and determine if the annexation petition is valid because of the petition to withdraw. Doug Lawson seconded the motion and it carried unanimously. Since the meeting, the attornies have met and agreed that up until the time the city officially accepts the annexation, an-nexation, people can withdraw or add their names to the annexation petition, Nickolson said. At the time the city annexes the area they must be certain they meet the state requirements; 51 percent of the property owners and one-third one-third of the assessed value of the property must be represented on the annexation petition. This Thursday the Boundary Commission Com-mission will also consider the Ashley Creek, 500 East 700 North; Showalter, 1500 West 100 North; and the Gibson-Hatch, Gibson-Hatch, 600 South and 500 East to east of Vernal Avenue, annexations.
