Show RALPH OLSEN FIGHTS TV TAX Ralph Olsen, a retired Duchesne Duch-esne rancher, is locking horns with the television ordinance, which requires television set users to pay an annual license of $12 to Duchesne County. Until the license fee was set up, last 'year, the county imposed a mill levy on real and personal property prop-erty to raise money to operate this television system. After the warrant of arrest and complaint was served by the Duchesne County Sheriff's office last week, the defendant sought legal help to fight the charge brought because Mr. Olsen refused re-fused to pay the 1965 television set license fee of $12. Mr. Olsen fs attorney's, B. Eugene Livingston and Wm. J. Cayias, Salt Lake City, have filed a motion to dismiss the complaint. This motion was scheduled to have been heard Monday in the District Court, but the district judge postponed court day to Wednesday. The Warrant was issued frorri the Duchesne City Court. In the Motion to Dismiss, the Defendant Olsen contends the television ordinance is unconstitutional, un-constitutional, and contrary to the constitution of the United States of America and of the State of Utah. The county enacted television tele-vision license fee last Marcly effective April 1, 1966. A sim-. ilar ordinance had been enacted enact-ed earlier by Duchesne City. |
