'fit Chief Justice Dartch gave the mem- Mr bers of the bar and the public gener- l ally a great shock a few days ago. ljj The learned Judge actually permitted t It to be given out through the newspa pers that he was going to resign within with-in thirty days. Tho bar not only of Salt Lake, but of tho entire state, was In consternation, and with one voice begged tho chief justice to temper justice with mercy by not resigning. It Is even Intimated that Arthur Brown, P. L. Williams and other prominent prom-inent attorneys prostrated themselves In the dust before the great jurist and beseached him with tears In their eyes i not to do anything so cruel as to re- j sign. It Is absolutely known that If I John M. Zano had been In Salt Lake j he would have led tho procession and joined his supplications to theirs. Truth Is overjoyed to bo able to announce an-nounce that Justice Bartch has reconsidered re-considered and won't resign. Tho dear, kindly man could not withstand the earnest, tearful pleadings of the lawyers and the public and has con-cented con-cented to sacrifice himself by not relinquishing until ho is oblldged to, a certain $5,000 a year for a precarious $500 a year which he might make In tho practice of law. In the entire time he practiced law before ascending ascend-ing tho bench he had one case. Tho resignation idea really did get into the chief justice's head. It came about In this way. Ho made up his mind that Senator Smoot should bo ousted or should resign from the United States senate. Ho even took especial pains to invite President Smith of the Mormon church to use his Influence to bring about tho resignation res-ignation of Smoot'. Justice Bartch (in his mind) having obtained tho resignation resig-nation of Smoot saw clearly that tho only reasonable thing for the govei. nor to do would be to appoint Justice Bartch to the place made vacant by tho retiring of Smoot. That's how tho resignation Idea camo about. But glory be! Bartch will not resign until un-til about October next when ho may tender his resignation to take effect about December 31 next at midnight. |
