| Show MEASURE ALSO introduced TO CLARIFY STAND AS TO navigability OF COLORADO RIVER governor george H dem wednesday afternoon signed the auerbach bill repealing ratification of the six state colorado river compact upon which the boulder dam bill now before congress is based to the usual formal letter of notification to the senate the governor added comments on his reasons for signing the bill and suggested for consideration certain future policies relating to the colorado nver problem almost at the same time the bill was being transmitted to the governor for his signature senator herbert S auerbach introduced senate bill no 12 clarifying stand in the matter of the navigability of the colorado and green avers and their tributaries tributa ries this bill declares the colorado river in utah and the green river in utah and such tribu baries of the two streams in utah as are navigable in fact for any useful purpose to be navigable streams and public waters and asserts the title of the state of utah to such water and the beds of such rivers and tributaries tributa ries the bill also explains and interprets article four paragraph A of the seven state colorado river corn pact in which the words inasmuch as the colorado river has ceased to be navigable for commerce appear as not intended as and not to be construed as a declaration of intra state policy in derogation of the rights and policies of the slate a set forth above the bill declares that adherence of the state of utah to this article paragraph is to be limited to the terms nd purposes of the colorado river compact as an interstate agree went for th between the states of the waters of the coir rado river for beneficial use the auerbuch bill repealing ratification of the six state pact was reached soon after the senate con A communication from the house of representatives announcing that the house had passed the bill was read and filed shortly after this the bill was reported out of the on engrossing mhd enroll ing and wis signed by 4 alonzo irvine of the senate th bill was then taken to the hous whap S M jorgensen at cached his signature when the bill hid been returned pd from the house it was sent to th iro vernor who efter reading it through signed it the pen with which the governor attach ed his signature was then delivered by messenger to senator auerbach the bill will row be filed with te secretary of state and copies will b dispatched under the provisions fa the act to the president of the unit pd states the secretary of state 0 the united states and to the govern nars of arizon california color do new mexico nevada and following is the letter of noti fica tion from the governor to the sate to the senate 1 I have this day approved and warded to the ecret arv of state ta no 1 by mr auerbach entitled an act chanter 64 laws of utah 1925 entitled an act approve ing and ratifying the colorado riv compact upon similar action by vf aix states which have already rati tied etc approved march 13 1925 my notion like vours was prompt ed by the urgent behest of our unit ed congressional delegation and w must assume that they had gcoy an sufficient reasons for urging us to fake this action it hardly seems necessary to remind you that the peal of the six state compact again exposes our state to certain danger from which we wre seeking partia protection when we ratified that corn pact it is therefore essential that a constructive program be evolved as as possible mav I 1 suggest that it might be helpful if the legislature memorial ize the federal power commission and request it not to grant any power li benses censes on the colorado river until the several states situated in the colorado river basin shall have arria at an agreement in regard to the di vision and ownership of the water of the river it is obvious that if the federal power commission should now grant power licenses which would permit the construction of reservoirs priorities might be set up in the lower basin to our permanent mav I 1 further suggest that th legislature might tc congress of the united states in position to senate bill no 1856 h mr cameron which admits of the construction of a birge power project near the laguna dam as a re suit of which additional priorities would 0 o established in the lower bas it is my feeling that we should not only display a spirit of ness toward the lower basin states but that we should make diligent ef forts toward getting all differences accommodated and that pending such efforts the status quo should be maintained |
