The case of Martha Gardner, charged with first degree murder for the slaying of Joseph W. Irvine, is set for October IS. Mrs. (lardner, also known ss Martha OerTane, waa convicted of Involuntary manslaughter man-slaughter as an accomplice to Ueorge Gardner, who la awaiting execution for the murder of Deputy Sheriff Gordon Stuart. Irvine waa killed later by Gardner and the state charged Mrs. Gardner with inciting the crime. She appealed from the verdict of the district court and will now go back to trial on the original complaint, which charged first degree murder.
