Under the bill it will be unlawful to sell adulterated "liquids" of any kind. - .The bilt gives the food inspector an opportunity to prosecute the sellers of impure and adulterated foods. Under th new law, a person does not have to have a full knowledge that the food is impure before he can be prosecuted. , What the. Law Provides.., ' The law prescribes, moreover, that "all dealers, clerks, bookkeepers, express ex-press agents, Tailroad officials, employees, em-ployees, or common carriers shall render all the assistance in their power, whea so requested, in tracing, finding or discovering dis-covering the presence of any . article prohibited by law and in securing samples sam-ples thereof. 7 ' . Refusal to comply with the request is deemed a misdemeanor. The law is also an improvement over the existing statutes in that it holds the dealer - responsible for infringements infringe-ments on its provisions, no matter whether be does no knowingly or not. The section . in . question reads . as - follows: fol-lows: . No person, firm or corporate body shall, within the State, manufacture manufac-ture for sale, offer for sale, have in possession pos-session with intent to sell, or sell any adulterated or misbranded article" of food or substance to be used in the manner man-ner of food or drink. It shall be unlawful un-lawful for any person to sell or offer i for sale, or have in his possession with I intent to sell, any article of food that has become tainted, decayed, spoiled, or is otherwise unwholesome or unfit to bo eaten or drunk." As to Sanitary Conditions. -. ' Certain sections of the act are intended in-tended to bring about more sanitary conditions in hotels, restaurants, etc.,' and these may also result in greatly benefiting the public. ' According to Section 38, whenever it is determined; by the commissioner that filthy or unsanitary un-sanitary conditions exist in the operation opera-tion oi any restaurant,' hotel, bakery, confectionery, or ice cream plant or any place where food or drink products are stored or kept for sale the owners must be notified and "if they fail to notice the warning, they are guilty of a misdemeanor. It is made unlawful for persons afflicted with certain communicable com-municable diseases to be employed in any capacity which requires the handling hand-ling of food. ' . ' Slaughter houses are also to be inspected in-spected by the commissioner and he is authorized to formulate rules and regulation regu-lation to carry out the provisions of the act. ' - - " . i Provision also is made for conducting conduct-ing the dairy business. Milk must be whole milk and must contain not less than three and two-tenths per cent of fat and twelve per cent of solids. Milk from- which cream has been removed must be labeled and sold as "skim milk." The addition of coloring matter mat-ter or preservative to the milk is prohibited. pro-hibited. The label is to be placed on the outside of every vessel from which the milk is sold, in Gothic letters not less than one inch high. Diluted and evaporated milk must also b labeled in like manner. , . ' ;.. The Bale of Cream." Another sweeping clause is that which deals with the marketing of cream. It asserts that "cream of standard stand-ard . pnritv shall be cream produced from normal milk, free from all kinds of additions, and containing not less than 20 per cent of butter fat. The sale of Cream which is not of standard purity is prohibited and dealers are pro-! hibited from selling cream containing a less per centage of butter fat than is represented. The selling of cream containing viscogen is . not . prohibited of the product is labeled, Butter of standard purity must be made from normal milk or cream, free from all kinds of additions, except salt and harmless coloring matter, and must contain not less than eighty per cent of butter fat. On each package of butter but-ter manufactured and offered for sale the name and address of the manufacturer manufac-turer must be stamped on the wrapper, together with . the actual number of, ounces contained in the paekage at the time of its manufacture. . . ( The premises and utensils used in the production or transportation of milk or cream 'or any food products must be kept clean and in a sanitary condition, when utensils are returned from the consumer they must be washed immediately and thoroughly, cleanbed and aired. ; The penalty for violation of any of the provisions of the act is a fine of not less than fiftv dollars or more than two hundred dollars. |
