HAMILTON WAS NOT ALLOWED TO TESTIFY BEFORE THE COM- i MISSION. 1 . , J NEW YORK, March 30, The Thaw lunacy commis- j sion went into executive session ses-sion at 10:25 o'clock today. Harry K. Thaw was irame-.diately irame-.diately called before the board. His counsel reported him today as in good spirits and fully capable of standing stand-ing whatever mental' tests were put io him. x ' Dr. Allan McLane Hamilton, Hamil-ton, the alienist, who Avas summoned last night by the commission, was' waiting in the courthouse corridors when today's inquiry was begun. Dr. Hamilton said he did not know what was required of him. "I'm in the -hands of the commission, ? ' he said. There was much speculation as to the reajons which prompted the subpoenaing of Dr. Hamilton. One explanation was to the effect that Dr. Hamilton having stated upon the witness stand before Justice Fitzgerald his belief that Thaw at present is incapable of rationallvaH vising hia .counsel, the Junacy .onuhiBV sion cannot, afford to ignore- it if its records are to keep clear of objections. The examination of Dr. Hamilton is likely to be brief, for it is known fhat he has had no close relations with the defendant since last July. The alienist may - be asked ' his reason for stating that Thaw is of unsound mind today, and then the commission may place whatever value it desires on his testimony. testi-mony. Dr. Hamilton believes that Thaw is a paranoiac. Almost as important as the inquisition inquisi-tion and observation of Thaw by the commissioners will be the examination of the alienist. Dr. Allan McLane Hamilton. Ham-ilton. The news that he had been subpoenaed sub-poenaed was a surprise, as it had been hinted by Chairman McClure, Thursday, Thurs-day, that no medical experts would be called by the commission. The peculiar position Dr. Hamilton bears toward the case intensifies the interest in-terest in his testimony. ' He was one of the first experts retained by the defense. de-fense. He examined Thaw not long, after the latter killed White and he was furnished with data gathered in Europe and elsewhere by Thaw's original counsel coun-sel as to Thaw's pathological antecedents antece-dents prior to his shooting White, including in-cluding his trips with Evelyn Nesbit and the medical history of his family. Dr. Hamilton was quoted as saying that Thaw was hopelessly insane, and it was while he was on the stand, having hav-ing been called by the defense, that the appointment of the lunacy commission was applied for. He will probably be examined when Thaw's examination is finished and will, be questioned at length by the commission as to his reasons rea-sons for believing Thaw a paranoiac. Fresh sensations are looked for in consequence. con-sequence. Now that Dr. Hamilton has been subpoenaed, sub-poenaed, it is rumored that other alienists alien-ists will follow him before the commis-. sion. There is, therefore, much speculation specula-tion as to what the commission will be able to( reach a conclusion and report to Justice Fitzgerald. In any event, the hopes cherished by Thaw's counsel and by the prisoner himself that. the commission com-mission would close its work with, his examination have been shattered. , The persons in the Tombs, who have had anything to do with Thaw since he has. been confined there will also testify- before the commission. Included In-cluded in this number are Dr. McGuire and Dr. Campbell, respectively the prison pris-on physician and his predecessor, and such clergymen as have talked with the defendant. ' . . The commission la bending every, energy en-ergy to conclude its work this after-I after-I noon. It 'was stated today1 there had been a clash of authority before the commission as to; the custody of the i prisoner. . Police, Court Captain Lvhch wanted Thaw's prison guard to withdraw from the room, but. the latter declined to do. so without A' receipt for 'his prisoner signed by the commission. The guard withdrew during Thursday 's ' session, but today had different orders'from his superiors. He remained in charge. HORACE N. MARVIN, JR., KIDNAPED BOY FOR WHOM AMERICA AND EUROPE ARE SEARCHING.
