Show AN OPINION ON SEALING Supreme Court Holds That It Constitutes Common-Law Common-Law Marriage. An opinion handed down by the Supreme Su-preme court today holds that the "sealing" "seal-ing" of living persons under the rites of the Church of Jesus Christ of Latter-day Latter-day Saints constitutes a common-law marriage. The opinion was given in the objection to the partitioning and distribution dis-tribution of real estate belonging to the late Dr. John R. Park for Annie F. A. KUton, who the court previously held was the common-law wife of the .deceased. .de-ceased. ' Under a prior decision of the Supreme court, the lower court appointed commissioners com-missioners to partition and set aside Mrs. Hilton's share of the real estate . and other property. The executor of the estate objected to the precedure and took an appeal.. In Its opinion the Supreme court declares de-clares that there is no reason why it should reverse its opinion regarding the marital status of Mrs. Hilton. The opinion also asserts that the appellant went so far In his objection as to include testimony given before the 8 moot in- vestlgatlon committee at Washington. It is also asserted that conslrable evidence was unnecessarily Introduced in the petition presented to the court. The opinion was ' written by Chief Justice Bartch and concurred in by Justice Jus-tice McCarty and Judge George O. Armstrong of the District court. |
