Show JUDGMENT AGAINST C APT. J. R. DE LA MAR Under a decision given by Judge Morse, Joseph R. De La Mar will be compelled to pay the Tullurlde Power and Transmission Transmis-sion company $17. 458.68 for electrical pbwer furnished De La Mar's mill at Mercur, Tooele county. The Judgment was entered en-tered after a hearing before Judge Morse. According to the contract, which was made July 15, 1897, De La Mar was to pay 60 per ear per horse power. The defendant defend-ant claimed that the power company failed to produce the power continuously, and that there were manv and frequent delays. He further asserted that for , these delays he should receive certain setoffs set-offs or rebates. Under the ruling of the court, the company is held not to be responsible re-sponsible for interruptions due the elements ele-ments and not In the power of the company com-pany to prevent. |
