Show PETTIi CASE NEXT ON DOCKET Prediction is Made That it Will Take Longer Time to Secure Jury Than in Haywood Trial State Makes the Charge That Petti bone Was a GoBetween for the Socalled Inner Circle and Hired Assassins Prisoner In Poor Health Boise Idaho Attorneys on both sides In the Pcttibono case agree that it will require a longer time to secure a Jury iu this case than in the Haywood trial when nearly a month was consumed In tljls preliminary prelimi-nary work Petti bono was Indicted with William D Haywood secretary Charles H Moyer president and Jack Slmpkins member of the executive execu-tive board of the Western Federation of Miners In March 190G for tho murder of Governor Frank Steun enberg at Caldwell Idaho December 30 1905 He was arrested at Denver at the same time as Moyer and Hay wood and brought to Idaho following the confession of Hary Orchard In which he admitted killing Steunen berg with a dynamite bomb and charged that he held been hired to commit the crime by the federation officers Pettibone has no official connection with the federation but has been made an honorary member since his arrest It Is charged by the state that he was the gobetween for the socalled inner circle1 and hired assassins After the acquittal of Haywood application ap-plication for bond was made for Moyer and Pettibone The state refused re-fused to consent to Pettlbones release re-lease but Moyer was allowed ball in thesumof 25000 The trial ofPet tlbone was set for October 1 but was continued several times because of the defendants Illness Pettibono Is still in poor health but insists that he Is able to stand trial With two exceptions the same attorneys attor-neys will be engaged In tho Petti bone trial as in that of Haywood E F Richardson of Denver who was chief counsel for Haywood has retired re-tired from the case and Clarence Darrow of Chicago Is now attorney of record for the defense K I Perky of Boise has been added to tho long list of defense attorneys Others who will appear In behalf of the defendant de-fendant are former Congressman Edgar Ed-gar Wilson of Boise Peter Dreen of Butte John F Nugent of Boise Fred Miller of Spokane and Leon Whltsell of Wallace James H Hawley again appears as leading counsel for the state Senator Sena-tor Borah Is now In Washington and will remain there until after the convening con-vening of congress when he will return re-turn to assist In the prosecution Prosecuting Pros-ecuting Attorney Van Duyn of Canyon county where tho crime was committed commit-ted and W E Stone of Caldwell will also appear for the state II |
