Tomljanovich testified on direct examination ex-amination that he was at the home of George Mageros until after midnight on the niglit of the killing. "When he went home, he said, he noticed that Frakovich was missing, and when he asked his wife if she knew where ho was shj replied in the negative. lie and his wife then went to the bant, where Frakovich usually slept in his wagon, but did not find him.
