Show selection government has been very generous in the land grants to utah about millions of acres altogether came to alic state when admitted in somo sections of alie bbate opportunities are afforded for the selection of school lands from among the public domains that is true with regard to the reservations wherein the best of lands may be secured to the state if advantage is taken of existing federal laws our attention has been called to a statute of the united stales passed at the second session of the fifty third congress pages 6 which reads as follows that is ahall be lawful for tho governors of the states of washington idaho montana north dakota bonab dakota and wyoming to apply to the commis lioner of the general land office for the survey of any township or townships of public land then iu any of the several surveying districts with a view to satisfy the public land grants made by abu daveral acts admitting the said states aiuto abo union to tha extent of the full quantity of land called for thereby and upon the application of said governors the of tha general land office shall proceed to immediately notify the surveyor denoral of the application made by the governor 0 any of the said states of the application made for the withdrawal ol 01 said lands aad tha surveyor generah shall proceed to have the aurva so applied for mada as in the cases of surveys of public lands and the lands that may be found to fall within the limits of such township or townships as ascertained by tha survey abail be reserved upon the filici ef the application for survey from any adverse application by settle ment or otherwise except under rights that may bo found to exist of prior inception cep tion for a period to extend from such application for survey until the expiration pi ration of sixty days from tha date of the filing of ahn township plat of bur vey in the proper district doffice lan aurini lu rini which period of sixty days the state may select any of such landal not embraced in any valid claim for the satisfaction of such arante Rr ante the condition however that tho arnor of the state within thirty days from the date of euch of the application for survey shall cause a notice to ba published which publication ahall be continued for thirty dacys from the first publication in some newspaper of general circulation in the tha lands lindly to ba embraced kasuch township or townships diving notice to all parties interested of of auch application br survey andee exclusive right of selection by the state for the aforesaid period of sixty daya da herein provided for and after the expiration of such period of sixty days any lands which may remain by the state and not otherwise ape law shall be subject to disposal under general laws as other public lands and provided farther that the commissioner of the general land office shall give notice immediately of the reservation of any township Towne hip or townships to the local land office in which the land is situate of tha withdrawal of auch township or townships tor the purpose fore prodded and provided further that the governors of the herein named are authorized to advance conov from time to time for the survey ot the withdrawn at such united states depository as may be de BiRna ted by tie commissioner of the general land office and the money a BO advanced ahall be reimbursable the foregoing provisions shall be applicable to utah when admitted an a state into the union and a governor ia duly inaugurated augu rated and acting those provisions especially alie latter have been overlooked evidently in the framing of the present land law it is most important that the governor be given power to act under that law by placing at his disposal an appropriation the prodding which secretary hoka smith ia these days receiving may result in the opening of alie uncompahgre reservation before another cession of the legislature and it occurs to us that the state can profit by the opening of that reservation under the law juat quoted it is a matter that is at least worth alio attention of the legislature or if tho land bill liaa reached the governor it may be a matter of importance enough to return the bill with recommendation |
