Show FORMER BANKERS SUED FOR $2615.31 Amount Alleged to Have Been Used to Finance Shearman's Campaign. II. P. Clark, former president of too Merchants hank, toid Fred ISmih, former for-mer assistant cashier, are made the defendants de-fendants in a suit filed yesterday by the bank to recover $2615.31, alleged to be the unretnrned part of $8017.81 which the defendants aro alleged to have unlawfully withdrawn from tho Merchants bank to be used in financing the campaign of W. H. Shearman for election as city commissioner. The suit is filed hy the hank. The complaint alleges that the money was withdrawn from the bank between tho dates of September 25 and November Novem-ber 24, 1913. at a time when Mr. Clark i was president and Mr. Smith assistant cashier of the bank. Commissioner W. H. Shearman said yesterday that he was in no way responsible respon-sible for and did not at the time have any knowledge of the obtaining of any money from the Merchants bank in connection con-nection with the financing of his campaign. cam-paign. "No money was obtained from the Merchants bank by any arrangement to which I was a party or of which I had any knowledge, said the commissioner when he learned of the filing of the suit. "I really do not know anything about the matter. ' ' Commissioner Shearman's sworn statement of campaign expenses, filed within sixty days after his election, showed his campaign outlay to have totaled to-taled $4787.50. In another suit filed 'by the bank at tho same time yesterday II. P. Clark and tiie Western Securities company are made the defendants, the action being be-ing to get judgment for $10,000 alleged to have been unlawfully withdrawn from the bank by Mr. Clark during his presidency and carried in tho form of an overdraft. The allegation Is made in the complaint that the Western Securities Se-curities company is a dummy corporation corpora-tion controlled by Clark. t is alleged that, though the company com-pany was incorporated under the laws of tho state of Nevada, copies of the incorporation papers were never filed, in compliance with the law. with the secretary of state and the clerk of Salt Lake county, wherein, the complaint alleges, al-leges, the greater part of the company's business has been conducted. |
