Show HEARING IN LARCENY SUDDENLY STOPPED Attorneys for Morales Bring Up Point That as Witness He Is Exempt xf From Prosecution. Preliminary hearing in the case of the state of Utah against Ralph Morales, who is charged with grand larceny jointly joint-ly with "Jack1' Hilton, was to havo been had before Justice of the Peace Brigham H. Hilton has been held to the district court to answe- to the charge against him and Morales, rre alleged stealing of an automobile belonging to Guv Robinson Robin-son on Novemoer 15. Moraies tvr.s called by the state as a witness iu the case against Hilton, although he was not allowed to answer any materia! questions on the ground that to do so might tend to incriminate him. Attorneys Watts & Cecil and E. fi. Palmer, representing Morales, appeared yesterday with a motion thi-.t the complaint com-plaint against their client be dismissed because of the fact that ho had been called by the state as a -witness in the prosecution of Hilton. The Utah statute provides that the county attorney or other counsel representing repre-senting the state may request the dismissal dis-missal of the complaint against one defendant, de-fendant, indicted jointly with another, for the purpose of using him as a witness, wit-ness, but is silent as to action taken by counsel for the defense. ' Attorneys for Morales promised to submit a brief covering his question, and Justice Clegg will thereafter an- , nonnce his decision. |
