The litigation was over a point of mining controversy that according to Judge Dickson has never been definitely decided In a law court. It Involves the right ot a mining company to fallow the apex vein under a townsite when the mining company holds the junior claim. The Empire company followed the, apex of a vein under a townsite explained Judge Dickson The North Star com pany had bought the townsite from the ntrymen and protested the right of the Enplre company to follow Its vein under the otrcumat&neea. The Bmplre tt maintained It had the right I Instructed the engineers' of the Fmptre company to make an Investigation and arrange a compromise with the North Star people.
