Show JUDGE MUM SHS i he mm sun,: Decision Made on Importan Provo River Case in the Fourth District Special to The Tribune. PROVO, Nov. 29. Judge A. B. Mor-gan Mor-gan of the Fourth district court rodaj handed down a decision on the issiu raised by the plaintiff in the case of tl Provo Reservoir company vs. Provo Citj and others, claiming that Judge Mortar is disqualified to hear the case, in whicr contention some of the defendants als concur. Judge Morgan has decided tha he. is not disqualified and that he wil hear the case unless he is prohibited b, tiie supreme court, to which the questio may be referred. The case was set for hearing December Decem-ber 14. This setting has been vacate to give the supreme court time to act if the plaintiff take the matter up, and a resetting will be made later. The case is one of great importance, 'as It involves the right to the use of tht water of the Provo river in the thref counties through which it flows Summit Va?atch and L'tah. There are about 4-SI defendants, including all the canal companies com-panies using water from the river otbet than the plaintiff. Many prominent attorneys at-torneys of the state are connected witt ihe case. |
