Custer, Friday, filed in the district court an amended answer and cross-complaint to the action for separate sepa-rate maintenance against him by Minnie C. Custer, in which he charges that the plaintiff deserted him In 1S0U and wont to Butte, where she later attempted to and thought she did secure divorce from him. Acting upon that belief, he alleges, she went to Denver, where she married John P. Schmidt iu May. 11103. After learning of his wife's remarriage, Custer alleges, he then married his present pres-ent wife, and after his first wife was deserted by Schmidt and xhc learned that .-die hud ncVcr been divorced from Custer, she then came to Salt Lake and started an action against him for sepa-ralo sepa-ralo maintenance. Apparently Custer has two wives on .his hands and some time ago Judge .Mfise ordered him to pay temporary alimony ali-mony to his first wife. He now asks that her complaint be dismissed and that lie be awarded a decree of divorce. |
