The .bauk uHranteo laws of Oklahoma, Nebraska Ne-braska and Kansas were declared constitutional con-stitutional today by the supremo court of tho United Slates, and thus tho fight over tho policy of Guaranteeing, Guaran-teeing, through the state, deposits in banks was won by the advocates of such a policy. Opinions of the court were announced by .Justice Holmes. 31c said tho main objections to tho laws was that the assessment of banks by the state, in order to create u fund to guarantee deposits in other banks, took private property of one bank for the private- use of anothor without compensation. Justice Holmes admitted that there might be a taking of private prop-erty prop-erty without return to pay, debts of a failing rival business, but he said there were more powerful considerations considera-tions on the other side of the question. "In the first, place," he said, "it is established by cases that an ulterior public advantage may justify a comparatively com-paratively insignificant taking of private pri-vate property for what, in its immediate imme-diate purpose, is a private use. .Tt. would seem that there may be other cases besides the every-day one of taction, in which the share of each pa;ty iu the benefit of a scheme of mnrual protection is insufficient compensation com-pensation for the co-relative burden that il is compelled to assume. At least, if wo have a case within tho roasoimblo exercise of police power, as above explained, no moro need bo said." The .justice then proceeded ,to justify jus-tify the laws under the police powers. The police powers, he said, mav bo put forth in aid of "what is sanctioned by usage, or held by the prevailing morality or strong and preponderant opinion to be greatly and immediately necessary to the public welfare."
