Show DRAWING TO A CLOSE THE appropriation BILL KILLED bill amending ahe school law passes FIFTIETH DAY FEB 27 1888 COUNCIL the committee on public health to whom was referred a petition from residents of manti city made the following report your committee on public health to whom was referred petition no 14 signed by john BL hougaard mayor of manti city and others complaining of sheep being dipped and pas aured in manti city canyon and asking for the enactment of a law to prohibit the herding of sheep in any canyon in utah territory when the water from such canyon is the only source of supply for certain localities tor domestic purposes report that said petition has been duly considered that it is the opinion of your said committee that to enact such a law which would prevent the ranging or pasturing of sheep or other ani mals in said canyon or any other canyon in this territory with such an extensive ranging district where lands are for miles around entirely mountainous and suitable for range or pas tare and gradually sloping toward streams which are used for domestic purposes and from which streams it is positively necessary for all kinds of animals to obtain arter would work a hardship against the general welfare and bring about a revolution such as would be felt to the detriment of all financial circles in this rv your committee further believes that the laws now upon the statute books of this territory if properly enforced will abate and prohibit all nuisances and that no further enactment of law is necessary in the premises very respectfully BRYAN chairman adopted the joint committee on memorial to whom was referred the memorial to congress asking for certain lands for the benefit of the orphans home reported as follows your joint committee on memorial to congress to whom was referred a memorial to congress asking for a grant to the territory of ten acres of the fort douglas military reservation for the purpose of an orphans home would respectfully report that they have carefully examined tha same and with ten amendments thereto and inserted therein recommend that it be adopted and passed MARSHAL adopted mr woolley stated that there was pending in congress a bill authorizing the removal of the ute indians from southern colorado to this territory he did not think utah wanted the indians and it would be unjust to have them brought here he therefore moved that the matter be referred to tho committee on memorial to frame a protest against the passage of such a bill carried mr bryan introduced C F 38 a bill to amend sections 6 and 8 chapter 3 title 4 of an act defining the boundary of counties and locating county seats the bill was read for the first time and referred to the committee on counties the memorial to congress asling for tea acres of land for the of the orphans home was read for the second time mr woolley said he had some doubt as to the propriety of presenting the memoria Tto congress mr marshall said that at an early day such an institution would be a necessity in this territory and would need to be fostered alte territory had received very little from the national government in the way of appropriations and it was not too much to ask for ten acres of land upon which to erect a building further consideration of the memorial was postponed and it was ordered printed the council then adjourned HOUSE the council informed the house that it bad concurred in house amendments to CF 1 in relation to banking had passed EL F ag prohibiting the sale of tobacco to minors also H F 61 providing for the election of members of tho legislature etc H F ag substitute in relation to marshals serving executions in civil cases was read the third time rules suspended and the bill put upon its passage the bill failed 12 ayes 10 noes not the the requisite two thirds in the affirmative mr hoges bill providing an appropriation of 2000 to the deseret st marys and st marks hospitals respectively was next taken up the vote stood ayes 11 noes 11 a tie vote and ane bill failed mr moyles bill for an act to for the custody and use of books in the territorial library came up it was amended slightly and mr alien objected to moving the books away down to the university mr moyle was in favor of it the library as it now stood was utterly useless and there the would be of some benefit v the boio was ayes 15 noes 5 sev eral not voting and t therefore passed 0 fc H a bill for an act to provide for the changing of towns precincts and school districts was passed ayes 19 r noes 1 t s the following bill for an act for the protection of game passed ayes 17 noes 6 it is as follows SECTION 1 be it enacted etc that every person who between the fifteenth day of march and the first day of october in each year willfully takes kills destroys or offers for sale any kind of wild ducks or who shall at any time rob the nest of the above mentioned birds or who shall kill any wild duck between one hour after sunset and one hour before sunrise shall be guilty of a violation of the provisions of this act SEO 2 any person who shall inal of the kind generally known and designated as quail partridge or grouse or who shall have the dead bodies of any such birds in his possession within the confines of the territory of utah for the period of four years shall be guilty of a violation of the provisions of this act SEC 3 any person violating the provisions of this act shall be fined in a sum not less than ten nor more than fifty dollars SEC 4 section lof chapter 6 laws of 1884 entitled an act for the protection of fish and game is hereby repealed H F 17 substitute a bill for an act providing for the equalization of county territorial and school taxes was passed bya full vote EL F 37 the bill making appropriations was put upon its passage the item providing for the salary of the territorial librarian for the years 1888 and 1889 was out it being entirely unnecessary owing to tha action of the house in transferring the books to the university i mr hatch also wanted the fifteenth item allowing 1000 for attorneys fees in the auditors office for the years 1888 and 1889 stricken out had ascertained that the firm named as attorneys had received no money for over one year and a half it should not be allowed the motion was carried the first item appropriating 1500 for the commissioner of district schools was also i ing the action of the committee on education in reference thereto and the bill then passed hoge being the only one voting in the negative the beform school bill was once more taken up this time however on its third reading the bill was once more informally laid aside and other business taken up mr alien presented the petition of J M armstrong and sixty others asking for the passage of a local option law committee on elections mr jones petitioned for an appropriation pria tion of to be used tins and roads in box elder county committee on highways presented a petition from the county court of davis county asking for an appropriation to build a bridge over the weber biver mr farsworth presented tho petition of the assessor and collector of iron county asking relief from uncollected taxes committee on claims mr richards offered a bill for an act to amend sections 2 and 4 chap ter 45 claws of 1884 committee on private corporations mr ilund presented a bill to establish an agricultural college and experimental peri mental station committee on agriculture mr creer presented a bill for an act amendatory to an act concerning the branding herding and care of stock committee on livestock considerable of Kich aids bill for an act to establish a uniform system of county governments was resumed amendments made and ed for consideration tomorrow to morrow the committee to whom had been referred C F no 2 providing for proceedings in insolvency referred it back without amendment and recommended that it be put upon its passage ELF 20 mr moyles bill for an act providing be annual ly appropriated to the university under certain conditions was read the second time and bonding further action the house adjourned t FIFTY FIRST DAY FEB 28 1888 COUNCIL the council was notified that the house had passed H F 62 providing for the education of normal students A communication was received from the house notifying the council that it had passed H F 55 providing for the custody and use of books in the territorial library the council was advised that the house had passed H F 70 a bill to provide for changing names of towns precincts and school districts the council was notified that the house had passed the substitute bill for H F 40 and H F 49 amending the law in relation to fish and game H F 7 substitute an act providing for a territorial board of equalization having been passed by the house was read for the first time and referred to the committee on ways and means H F 73 making appropriations for general purposes was taken up on its arst reading and referred to the committee on appropriations the committee on insane to whom was referred C F 18 a bill in relation lo 10 the establishment of a insane asylum reported the bill back with some amendments and recommended that the bill be put passage adopted tho committee on counties to whom was referred C F 38 a bill de fining county boundary limits and locating county seats recommended that the bill be placed upon its passage adopted the committee cu enrollment to yas referred CF 31 a bial in relation to banking reported that the same had been properly enrolled and sent to the governor his action thereon adopted the coni nutte on judiciary to whom was referred C F 37 a bil in relation to the of mining grounds recommended that the bill iye rejected adopted the same filed for second reading mr smoot presented C F 39 a bill to amend sections and chapter 6 title 11 of the code of civil procedure the bill which empowers marshals to serve papers in civil processes was read for the first time and referred t the committee on judiciary H P 55 in relation to the custody and use of books in the territorial library was taken up on its second reading on motion of mr young the bill was so amended as to admit ahe general public to the library at all reasonable hours tho bill was then passed under a suspension of the rules C F 38 in relation to county boun daries etc was taken up on its second reading and passed under a suspension of the rules on motion of mr olson the council adjourned HOUSE H F 62 a bill amending the school law passed under a suspension of the rules by a vote of 13 ayes synopsis of this bill will be found in our issue of feb 17 i H F 76 king s bill for an act providing for the incorporation of cities came up on its second reading there was but little of interest in the consideration of this vo lummous document until section 31 was reached which read as follows to prohibit or to regulate all public demonstrations and professions processions process ions which interfere with public traffic and to allow and order paid out of the general tax a reasonable amount for the celebration of the anniversary of oua national independence i mr thurman moved that all the words after the word traffic be stricken out the motion was agreed I 1 to after being under consideration for over three hours the bill was formally laid aside and the house took up richards Kic hards county government bill which had been made the special order for the day amendments were made all rules interfering were suspended and the bill passed by a party vote A communication from the council announced the passage with amend ments of H F 55 a bill to provide for the use and custody of books in the territorial library amendments were concurred in also that it had passed 0 F 38 mr kimball by permission of the house introduced and had referred to the livestock committee a bill to provide for the revision of the brand sheets mr roueche from the committee on agriculture and irrigation reported back with amendments H F 8 providing for the establishment of an agricultural college and an experimental station and asked that it be put upon its passage adopted mr hoge of the committee to whom had been referred the communication muni cation of marshal dyer asking an appropriation for the purchase of a safe for the user of the warden of the penitentiary reported favorably and be appropriated adopted mr reported with amendments and asked that it be put upon its passage H F 68 a bill in reference to estraya and impounding animals adopted H fr 56 prohibiting tho sale of tobacco to raiders rai Dors H F 57 providing bounties on certain animals and birds H F 61 providing tho time for the election of members to the legislature etc were reportedly report edby mr king as having been properly enrolled and forwarded to the governor mr thurmand Thur mans now bill amending 1 chap lof the laws 1884 went to the committee ou private corporations mr creer from the committee on elections reported back favorably H F 30 providing for the prohibition of tha salo of liquor under certain conditions mr offered a resolution calling upon the auditor of public accounts to furnish the assembly with the names of all persons owing the territory and the amounts due adopted the incorporation bill was again resumed and it occupied the attention of the members of the house for one and tareo quarter hours at which time it was filed for its third reading H F 30 was brought out tor second reading when mr hatch moved ana adjournment until after considerable wrangling the house adjourned until 10 wednesday morning |
