Show FAUST CREAMERY COMPANY ' SUED BY OGDEN BANK The Ogdcn Savings bank filed an action ac-tion against tho Faust Creamery and Supply company In the Third District court Monday to collect $33,575.25, alleged to bo duo on four promissory notes, with J3357.50 additional as attorney's fees. The dates of tho notes nnd tbe amounts follow: March 21), 1907. 515.000: Jannarv 2S. 190S. 51700. March 23, 190S. 513,215.25: April 20. 190S, $5000. The last two notes wore executed to" the First National bank of Ogden and asalgnod to the plaintiff. Joseph Gcoghegan, the now president of the Faust Creamery company, succeeding suc-ceeding II. J Fnust, who recently re- ' . signed, said Monday afternoon that the entire assets of tho company had been assigned to him bint Friday. Mr. Gcoghegan Gcog-hegan nald that It was the purpose of the company to continue In business and to pay all of the creditors of the company com-pany 100 tents on the dollar and to protect pro-tect the stockholders of t tic company. "The available assets of Mm compnnv would not amount to much." said Mr. Geoghcgan. "and the only way that it will be possible to protect all of the creditors and the stockholders Is to continue to I carry on the business. Tho assignment was made to prevent discrimination on the part of any of the creditors." Mr. Gcoghegan said that the filing of the action was probably dono to protect tho holders of the notes legally and would not affect the continuance of the business. |
