Show FULLY vindicated the charges of fraud against receiver dyer come to naught ou wednesday afternoon examiner harkness filed his report in regard to the investigation of the charges made against dyer and his attorneys P L williams and geo S peters by certain school trustees in regard to the church suit the report occupies thirty pages of typewriter copy and too lo ig for publication icis however a complete vindication of the accused from every charge preferred against them in the trustees petition the report first takes up the compromise of real estate submitted to the territorial supreme court for approval on the ath of july it was in this that it was alleged that the court was misled judge harkness finds from the evidence that receiver j dyer acted in good faith and under the advice of his counsel there was no evidence of any intent to mislead the court in any degree and no intimation in that line but all was done in an honest purpose the sheep question next receives attention and the examiner finds from the evidence that the renting to pickard was done in good faith there wai nothing to imply an adverse condition the receiver was evidently doing the best bad faith or dishonesty of intention the personal property compromise came next in order in this the document states that the compromise for was also in good faith and under the advice of the attorneys in the case there was not effort or intent to conceal any of the facts or to mislead any one As to the receivers taking more the says that taking into consideration the extent of country over which it was scattered the circumstances dundei which it was held the variety of classes to which it belonged and the magnitude of its quantity as well as the efforts of the church to conceal it and the length of time they had to dispose of it and to make the fight in their own defense there was no intentional omission on the part of the receiver to take into his possession any property which ho could reach his action in this line was with proper energy and in good faith As to the compensation claim both of the receiver and his attorneys there was no evidence of fraud corruption official misconduct or fraudulent or unconscionable claims or charges on the part of the receiver or unconscionable claims or unprofessional conduct on the part of his attorneys in respect to the transactions set out in tho petition and upon which the charges were based |
