Show KAIGHN ON THE STAND Accused Tells the Story of the Shooting of Haynes COULDNT RECALL DETAILS No Trace of Insanity in Roy Kaighnfi Manner Yesterday as He Told of His Quarrel With Haynes and the Impulse Which Led Him to Shoot Confessed That Ho Wns Addicted to Cigarettes and Absinthe and at Times Vim Wholly Unconscious of His Own Actions I Roy Kalghn was put on the witness stand In his own behalf at yesterdays session of the murder trial In the District Dis-trict court He nilatod all ho could remember of Ihe circumstances surrounding sur-rounding and prompting the ahootlng and told of having witnessed a portion por-tion of Hayneso attack upon JIlBS COutes Whatever his condition at the time of the tragedy there were no signs of neivousnesB or mental disorder In his demeanor on tho witness stand He answered the fire of questions put to him clearly and firmly lIe said he fired on an Impulse of ttclfdefcnse believing be-lieving Haynes was about to draw a revolver I Young Knlghn was called to the stand early In the session after the cross examination of Miss Coates had been concluded He said In answer to questions ques-tions that ho began the use of cigarettes fully ten years ago and that he began drinking abslnthu about a year before he shot Haynes Often he stated he WitS unable to sleep because of nervousness brought on by excessive exces-sive drink drinkSAW SAW THE PARTING Kalghn said that the t night before the tragedy he retired early and was awakened by the sounds downstairs Jumping out of bed he pulled on his trousers and ran downstairs He saw there had been trouble between Miss Coatee and Ilaynes = but finding that Miss 1 Coates was master of tho sltua lion he said nothing but went back to bed He said ho heard Miss Coates order Haynes from the house SPENT SLEEPLESS NIGHT After I got back to bed Kalghn stated I could not sleep so I got up and spent the night smoking and drink ing The next morning I was not hungry I stayed nbout the house most of the morning and then took a car down town I remember going In to the Black IIllls saloon and several other saloons but have little recollection recollec-tion of what happened before I reached the Salt Lake Hardware store INTERVIEW WITH HAYNES Young Knight said that after he met Haynes In the lobby at the Knutsford hotel he demanded an apology I to his father and to the family for the occurrence occur-rence of the night before Haynes replied with nn oath he said and made a move as if I to draw a gun He then pulled out his own revolver and fired After that he could remember nothing of what occurred As to his actions at the police station and the statements made by him there he said his memory was a blank When crossexamined by District Attorney At-torney Elchnor the defendant said ho had no recollection of having a revolver re-volver that he did not remember which pocket he carried It In nor did he remember re-member buying the weapon and asking ask-ing the clerk to load IL The cross examination occupied tho remainder of the morning session Drs Nllos and rtascom were put on the stand by tho defense at the afternoon after-noon session as Insanity experts After the defendants actions had been minutely described both doctors gave It as their opinion that Kalghn was mentally unbalanced at the time of the shooting EFFECT OF CIGARETTES I think It would have been Impossible Impos-sible said Dr Niles for a person to have used cigarettes and stimulants since he was but 10 years of age without with-out becoming weakened mentally He said Hint In examining the body of Hnynca after the shooting he found a slight abrasion of the skin such as might have been caused by a bite How old are you doctor naked Mr Elchnor on crossexamination Dr Niles blushed furiously and looked appealingly to Judge Morse You may answer ordered the court uTm Id answered Dr Niles He was questioned about the mental process by which he arrived at the conclusion con-clusion of Kalghns mental Irresponsibility Irresponsi-bility and then excused Dr Bascom on crossexamination said the fact that Kalghn bought a revolver re-volver and went to the hotel In quest of Haynes would not Indicate either that ho wan sane or Insane INTERVIEWED MISS COATES Eugene Traughber a reporter was then called to the stand by the State Mr Traughber said he Interviewed Miss I Coates after the shooting and she told him In regard to the trouble between I herself and Haynes that he would be surprised If I he know how little the I trouble nmounted to c A scorching crossexamination was being conducted by Arthur Brown when the session closed It Is thought all the evidence will be before the Jury I at the close of todays session |
