Show SUIT AGAINST THE CITY Alcatraz Paving Company Wants Pay for Paving The echoes of the big city paving contract con-tract have taken tho shape of a suit In the United States Circuit court tho papers pa-pers for which have been filed in duo form Tho Alcalrnz Asphalt Paving company of California is the complain nnt demanding judgment against the city of Salt Lake far 7830 Interest at 8 per cent from December 31 1 JD02 and costs In the complaint the plaintiff recites that on August G 1901 It contracted with the city to pave grade and curb Second South street between First Vest and Sixth Vest Third South between Slate and West Temple and to make certain I repairs The work was finished on November J2 f t v 3002 According to the agreement the r City Engineer was to mnlcc monthly estimates S es-timates of tile work finlsjicd at contract prices and K per cenfof the estimate was to be paid while 15 per cent was kept out Within ninety days after tin completion or the work the Cllv Engineer was to make a han estimate and the balance E I due the asphalt company was to be paid This was done December 12 1 lJ02 and the Board of Public Works approved the estimate and accepted the work Tho l total amount was SIHMSfKJ of I whlrh S120ft1972 had been paid leaving I 52a7Si21 due Tho Board of Public Works approved of the work on January in 1903 and on Feburary 9th the City Council recommended payment of SliiOJlJl 1 but I refused to pay 7850 This claim was pre ucntcd on November 1st lo the Council and again rrfusrd and now Judgment is I risked IX B Hempstcad and Andrew Howat are attorneys for the asphalt com puny lwnCity Attorney Nye has filed f a paper slating that the city enters Us appearance appear-ance and takes until January 10 3WM to plead to tho complaint |
