Show BOARD HAS ALE POWER Opinion Rendered by City Attorney Stephens I Before making an absolutely mandatory I man-datory request of the Board of Education I Educa-tion to exclude from attendance at the public schools all unvacclnalcd children chil-dren tho city Board o Health requested request-ed City Attorney Stephens to furnish it with an opinion as to whether the I Board of Health las the power to I make such a demand Tho City Attorneys At-torneys opinion which was delivered Health Commissioner King last night is that the Board of Health under Iho l statutes and Iho city ordinance has ample power lo make such demand and the Board of Health will at onco proceed to do so l Mr Stephens in his opinion refers to subdivision Ofi section 20C capter I Revised Re-vised Statutes of 1S08 which gives thc I City Council power to make regulations regula-tions to secure the general health o I the city to prevent 1 the Intoductlon of contagious Infectious or malignant I diseases Into the city and to make I quaranlinc laws and enforce the same within the corporate llmlls i i I and within twelve miles thereof To create aBoard a-Board of Health amid prescribe the nnl IJecr I powers of the same The Oily Council passed an ordinance I in accordance with the I above which Is found on page tW of the Revised Ordinances Or-dinances of Salt Lake City of 1SU2 and which empowers the Board of Health among other things lo use all due measures lo prevent the introduction Il spread within the city or within live miles thereof of any malignant contagious or Infectious I diseases a And lo adopt such rules and regulations I regula-tions necessary to prevent the Introduction Intro-duction or spread of malignant contagious conta-gious or infectious diseases within the cIty or within live miles thereof Chapter 2 sections 31015 to 1110 inclusive in-clusive of the Revised Statutes further fur-ther prescribing the duties of time Board Health are then referred lo which in substance is that the boar l may oslablish such sanitary rules and regulations as may be necessary to promote the general health and to prevent the outbreak or spread of infectious in-fectious diseases and to provide penalties pen-alties for the Infracllon of any such ordinance I Mr Stephens lien concludes his opinion as follows In my opinion thr provisions quoted give the local Hoard of Health ample power to require re-quire the school old to exclude un I acclnaled children from attendance at the public schools wherever In the reasonable rea-sonable exercise of Its judgment such I exclusion is deemed necessary to prevent pre-vent the spread of smallpox |
