for jrarcrarcttu V Rogers of Park City The complaint sets forth that the plaintiff intrusted William M Fern also of Park City with 500 shares of clock In the Putnam Mining company and charges that Ferry used his power of attorney to vote the property into his own hands and thence turned It Into the Quincy for 33000 shares of Quincy stock Mrs Rogerss Putnam stock was given her according to the complaint In the summer of 189C to satisfy a claim for S50 she held against Ferry with the understanding that Ferry should have a power of attorney to volt the stock and that he should protect vote and control the stock as he would his own He represented It Is alleged that the property was bonded for 300 000 I and that If the bond was taken up she would receive about S3 per share From that date until December 18 lS19 Mrs Rogers heard nothing more about her Investment and on the latter date she received a check for 24250 as a dividend from the sale of the Putnam r And eleven other claims of the Putnam company She avers that before cashIng cash-Ing the check she went to the olllcesl L of the company and was told by the secretary Montague Ferry a nephew of the defendant that the bond had been reduced from 300000 to SDOOOO and that Ferry had received the same 1 price per share as the other stockholders stockhold-ers and no stock In any other company com-pany Thereupon Mrs Rogers cashed the check Later she claims she learned that the defendant and his associates had secured and taken up the 50000 bond on the Putnam and turned in the Putnam Put-nam property as full payment the stock of the Quincy Incorporated November No-vember 27 1800 with a capital stock of 7GOCQ It Is alleged that the defendant defend-ant came out of this deal with 30000 or 35000 shares of Quincy worth 20 per share as well as the dividends on his holdings of Putnam stock It Itf l stated that the Quincy is now worth 70 per share and has paid 7 per share In dividends Mrs Rogers asks that the court decree de-cree that the defendant was acting as trustee for the plaintiff in obtaining and disposing ofr the lease and bpnd while voting her stock and that she he awarded Judgment for her proper proportion
