Bing-ham. f Alleged Illegal F.jectment Before Commissioner Com-missioner Greenman Civil Setting Judge Kroeger Decides a Civil Case. In the case of H. G. Gregory vs. Arthur Meads, in which the plaintiff sued to recover a piece of land valued at $4000 and situated on the East bench, the jury this morning re-turned re-turned a verdict in favor of the plaintiff. A DAMAGE SUIT. The case of Benjamin Duncan vs. The Denver & Rio Grande Western was then taken up, Judge Powers and Glenn & Guuter appearing for the plaintiff and John A. Marshall Mar-shall for the defendant. The plaintiff alleges al-leges that in November, 1800, while he was employed by the defendant as a section hand, it became necessary for him to enter a tool car and construct a wooden wedge; that while thus engaged, the car was suddenly sud-denly started, causing him to run forward, and threw him against a stake, which entered en-tered the right eye. He claims that the accident ac-cident was due to the carelessness of the defendant de-fendant in starling the car without giving him warning, and claims damages in the sum of $10,350. The defense denies all the material alle- gations of the plaintiff, and the case will go to the jury late this afternoon. For Illegal Ejectment. Peter Sutherland et al. will today institute proceedings against the representatives of the estate of J. M. Young, deceased, to recover re-cover the value of certain improvements made by them on Plum alley property, and from which they claim to have been unlawfully unlaw-fully ejected. I. S. Markham is the attorney attor-ney for the plaintiffs. A Mining Suit. Frank Hoffman, H. Denhalter and L. E. Holden this morning brought suit against Thomas Venard et al. to recover possession of certain mining property at Bingham, claimed to be the area in conflict between the north and south Eldorado and the Sanders San-ders claims. Interesting Court Notes. Justice Kroeger has given judgment for the plaintiff for $25.. "it in the case of Cun-nington Cun-nington A Co. vs. G. H. Uorton. The trial of the civil suit of Isabella Lang-stroff Lang-stroff vs. Alice Thomas, in which the plaintiff plain-tiff seeks to recover $31 for rent, has been on trial before Commissioner Greenman all aay, aud will be submitted in the morning. The case of Litchfield vs. Whitehead, involving in-volving the ownership of some lumber with about $100, which was recently decided in favor of the plaintiff by Commissioner Greenman, has been appealed to the Third district court.
