The evidence was taken on u system of transfer, the plainlitf having no commahd w hatever of the r'.nglish language ami the burden of his grief coming through on Interpreter, The plaintiff is represented by Judge Dickson and Mr. Stroup and the defense by Judge Marshall. Cuss llito's Trial. The Criminal calendar was opened before Judge Blackburn nt I'rovo this morning, at which time the ease of the people against Cass llite. charged with murder was called. The tragedy was enacted at Blake, on (Ircen river last fall, at which time Fred Kohler met his death. The principals had been at outs for some time and meeting Kohler opened lire with a Winchester rille. Not to be outdone in the smoke of battle llite the shots with deadly effect. A coroner's jury was empannefad, the case was ventilated and a verdict of justifiable homicide was rendered. The case was re opened, however, and Bite was Indicted for murder. At the same time Bhatffer ami Burgess who were witnesses to the homicide were indicted and subsequently released on bonds In the sum of $6000 each. They will both be tried at Ibis term of the court. The council opened with Mr. King in the chair. After prayers by the chaplain and reading of the journal, the council settled down to the business of the forty-secon-day.
