Show TRUSTEE S SALE WHEREAS LEONARD S. Osgood and Ruiiia L. Osgood, his wife, on the first day of December. le91, made, executed and delivered to Emil J. ftaddatz their certain promissory note for the principal sum of threw thousand three hundred and sixteen 30-100 dollars, payable to the order of said Einil J. Ra ldatz, ninety days after date thereof, with interest thereon there-on at the iate of one (1) per cent per month until paid, and Whereas, To secure the payment of said note the -aid Leonard S. Osgood and Bama L. Osgood on said du made, executed and delivered to ts. McDowall aa trustee for the said Emil J. Rad-datz Rad-datz their certain trust deed in writing of that date, which said trust deed was dulv certified, acknowledged and recorded in the office of thu County Recorder of Tooele County, Utah Terri-torv, Terri-torv, on the third day of December, 1891, and thereby conveyed to said McDowall the following mining property, to wit. : An undivided three-fourths three-fourths (L) interest of, in and to the "No-U-Don't" Lode, mining claim, situate in the Rush Valley Mining District in the said County of Tooele, designated as U.S. Survey, lot No. H, and more part n ularly described in and by said trnst ded. Also an undivided three-fourths ii, i interest inter-est of, in and to the Laura Lode, minin" claim, situate in the ail Rush Valley Alining District, Countv of Tooele, Utah, more particularly de scribed in and by the location certificate thereof, recorded in Book F, at pas "f the records in" tho office of the District Recorder of said Rush Valley Mining District and in and by said trust deed." Also one (1) upright boiler, engine and blower now upon said ''No-l'-Don't mlninv claim, and Whereas, it is provided, in said trust deed that I in case default be made in the payment of said j promissory note, that the said trustee might pro-i pro-i ceed to sell, and sell and dispose of said pifimlsen or any part thereof, and all richt, title, benefit j and equity of redemption of the said Leonard s. I Osgood and Huma L. Osgood, their heirs and assigns therein either in mass, or separate parcels par-cels at public auction on said premises or any I part thereof, for the highest aud best price tho same will bring in cash, twenty days previous notice of such sale haviug beeu given by publication pub-lication in anv newspaper at that tune published pub-lished in the county of Salt Lake, Utah Terri-tory, Terri-tory, and out of the proceeds of such salt, Aral to pav th- cost of advertising, selling and conveying con-veying said premises, including a reasonable commission to the trustes for his ervices ami a reasonable attorney's fee and all other expenses of this trust. ... Secondly, to pay to the holder et said promissory promis-sory note such " sums as he may have paid for taxes or asseaaMBt on said premises, or to extinguish ex-tinguish auy outstanding title or liens thereon. Thirdlv, to pay the full amount of said promissory promis-sory note, together with interest thereon, aud, w hereas, the said Leonard S. Osgood and Emma L. Osgood have nut paid said promissory note, nor any pail theioof, and the same is past due and I payable -Now, therciire, in consideration of the ? remises, and of the power vested in me by said rust Deed and by request of the legal holder of ! said promissory note, 1 will, on Monday, the (13th) Thirteenth dav cf June, 1893. at 1 o'clock p.m, on said dav, at and upon said "No-You-Don't" Mining claim, in the said Countv of Tooele, sell I said described property to the highest bidder for I cash, or so cinch thereof as may pay said note j and interest thereon, trustee's and attorney's fees and the expenses of said trust as provided iu said trust dfed.
