No matter what the na-ture of the indictment tho tragedy will be reproduced in all its naked ugliness before a verdict is entered. house In and for the Fourth precinct, for the purpose of electing a mayor, recorder, etc., of the city of Salt Lake; that the plaintiff, John Xoonan, then was and for a space, of more than six months had been a citizen of l.'tah and of Salt Lake, and then was and for the space of time required by law had been a resident of the Fourth precinct and was a legal elector and was duly aud legally registered and enrolled on the registration list of the Fourth precinct; that plaintiff offered to the judges of election his vote and requested them to receive and deposit the same; that the defendants not regarding their duty, wrongfully refused to receive or deposit the ballot, although they welt knew that plain-tiff was a qualified voter; whereby plaintiff was deprived of his vote at this election to a damage to the plaintiff in the sum of $:!()l). The Desperale Attuek of a. Madman on a Neighbor. Deputy United States Marshal Al Dyer came up from Granger about 4 o'clock yes-terday afternoon having in custody Andrew Ekstee, one of the fanners of that locality, who is ehnrged with making a murderous assault noon Hans Hansen, a neighboring farmer. The affair all grew out of a "bole in the ground," not like that around which Charles lloyt, the alleged dramatist, has woven an alleged farce, but one that threat-ened to f itrnish the. nucleus for a bona fide tragedy. According to Hansen, the prose-cuting witness in the case, the defendant dug a holo ih the public highway, which, it la claimed, imperiled the life of the voyager and the offense was reported to the supervisor of roads. That officer is-sued im order to Eustee to fill up tho hole and delegated Hansen to serve it. He rode over to the neighbors and served the notice. Eustee was at once aroused to the heat of a July day in a bay field and seizing pitchfork slarled for Hansen, whose horse plunged and throwing ils rider over the fence fell against the barbed w ires, ripping its bide Hansen who was without arm took to his heels and only hi skill us a runner saved him from death.
