The opin-ions were opened by justice iliner who, in the case of Tho People vs John Flyuii, convicted of grand larceny and sentenced to two years in the peniten-tiary denied thu appeal and alliirmed the judgment of trie lowor court. The judgment of the lower court was adirmed in the case of Smith vs Law-so- n aud Kohmcr vs Chadwich Jus-tice lilackburn delivered the opinion. In the case of tho United States vs. L. A- - Scott Elliot, Judge Anderson de-livered the opinion of the court. This was an actiou brought, against tiio de-fendant for unlawfully enclosing school lands. At the trial it appeared, the school laud in question had been sur-veyed by the government, and the de-fendant owned laud on both sides of tho section. In fencing his own land he en-closed some 40 acres of the school land. At the trial the defendant claimed that had acted in good faith and intended to acquire the title to the land. The court decided for the plaintiff, and the de-fendant was ordered to remove the fence within a giveu lime. From this order an appeal was taken, and the question arose as to whether sections of school land which had been surveyed by tho government wore what is known as government land. This question was discussed in the opinion at considerable length, and the court reversed the judg-ment of the court below. In the case of Hong Sling vs. Tho National Assurance company, of Ire-lau- d the judgment of ttie lower court which awarded the plaintiff 8.VI0 was affirmed, Judgo Zane ronu't ring tho de-cision.
