Show PLEA EA IGNORED Judge Ritchie Will Decide Question of Appeal in Herndon Case According to law Judge Ritchie yesterday heard beard arguments arguments arguments ments relative to extending the time for filing a bill of exceptions by the city In Inthe Inthe inthe the Herndon damage suit which was the cause two weeks ago of a rather startling affidavit charging James Jamea Inge Ingebretsen Ingebretsen Ingebretsen bretsen the attorney for Herndon with unprofessional conduct made by H J Dininny assistant city attorney Dininni charged that Ingebretsen failed to sign sigi the bill as he had promised and that he heas heas heas as assistant city cit attorney had neglected to file the bill within the statutory time because of negligence V Ingebretsen replied that Dininny had threatened to publish him to the bar as asan asan asan an unfair attorney and that he had never promised to sign the bill as presented bj by b Dininny V The arguments on each side were heard yesterday esterday Ingebretsen being represented by A L Hoppough who argued that it was not due to the former that the bill was not filed tiled on time As It was not however Ingebretsen intended to take tahe advantage of the technicality and prevent an appeal to the supreme court from the decision of the jury awarding Herndon 1400 damages s for hr an injury Injun Judge Ritchie said that he would take takeno no cognizance of the unprofessional con conduct conduct conduct duct charge but would decide the mat matter matter matter ter according to law The court took the matter under advisement until Nov la Ii when the decision will be announced |
