Lcrtnzo Shot, president, end Members of' the LijLsljtice Council: G?ntlemen The oommittee on ju diciary, to whom wad referred titat p.3r'.ion of the governor's message relative to the reorganization of judicial judi-cial districts, and C. F.f No. 3, bill for an act defining the judicial districts dis-tricts in the territory of Utah, beg to report that we have fully considered the matter in its several bearings, and respectfully submit the following for your consideration : In hw message to the legislative assembly the governor says: "An the i territory is now divided, four-fifths of all the legal business centres in the Third judicial district, and imposts upon one judge tne labor intended for three, whicn he finds himself unable to dispose of tvith that dispatch which, under other circumstances, litiganLs would have tho right to expert. ex-pert. This is a hardship upon the l judge oi me itnru district, wno is 1 greatly overworked, and also upon the parties who are awaiting the trial of their causes." While aJmitting this to ho substantially correct, st far is the labors of the judge of the Third di.-trict court are concerned, wo think that ample remedy for the hardship complained of wiil be found in a provision of an act of congress, entitled "An act in relation to courts and judicial officers in the territory of L'tah," approved January 23d, 1874, better known as the "Poland bill," section three of which provides that : "whenever the condition of the business busi-ness in the district court of any district dis-trict is such that the judge of the district is unable to do tho same, he may request tho judge of either of the other districts to assist hhu and upon such request made, the judgo so requested re-quested may hold the whole or part of any terra or any branch thereof, and his acts ab such juoge shall be of equal force as if lie were duly assigned to ; hold the courts in such district." Your cornmitteo are of the opinion ; that this provides all the remedy needed, and deem any legist ition looking to the re-ditricting of the territory at the present time unnecessary, unneces-sary, and therefore report back the bill C.
