Violation of the I.uws for the Preservation Preserva-tion of Game ami Pnh. SOi Every person who, be-i be-i tween the first day of January and the ; first day of July in each year, lakes, kills or destroys any elk, deer, ruoun-1 ruoun-1 tain sheep or antelope, is guilty of a misdemeanor. Sec. 31o Every person who buys, sells or lias in his possession any of the game enumerated in the two preceding preced-ing sections within tho lime the taking tak-ing or killing thereof is prohibited, except such as are tamed or kept for show or curiosity, is guilty of a misdemeanor. mis-demeanor. Skc. 366 Every person who at any time takes or catches any fish, except wi'.h hook and lino, not exceeding three hooks to a line, is guilty of a misdemeanor. Stc. 3ti7 Every person who takes, catches, or kills any fish by the uae ol seines, gill or dip nets, baskets, traps or any device whatever, excepting us provided in section 368, is guilty of a nrsdemeanor. Provided, that the use of the minnow nets Bhall not be considered con-sidered within the meaning of this sectiou. Sec. 303 Every person who puts into the waters of this Territory, or who uses any poisons or explosive substances for the purpose of taking or destroying fish, is guilty of a misdemeanor. mis-demeanor. Sec. 309 IudianB taking fish, or game for their own subsistence, are exempted from the penalties proscribed pro-scribed in this chapter. Sec. 370 Every person who at any time within the next four years Bhall , take from any of the waters of the territory any shad, salmon, black boss, white fish, silver eel, or any other fish which has been or mav be imported or their progeny, or any oysters fr-ni any private oyster bed without the consent of tho owner, is guilty of a raisdtmeanor and shall be fined in any sum not exceeding four dollars for each fi-jh or oyter so taken. Sec. 371 Every person who shall construct or continue to keep any dam across any of the streams of; water in the territory in which fish migrate, in such a manner as to hinder or obstruct the migration of 6sh to and from their spawning grounds without providing a fish way and keeping it in repair as provided in the next soction, is guilty of a misdemeanor. Seo. 372 The fish way for the passage pass-age of fish in large streams of water in the dam mentioned in the preceding section must be made of plank, or other material equivalent thereto, in the form of a box, open at each end, not less than four feet wide and three feet high. Aud it must be fastened at the top of the dam, and the other end must extend ex-tend to and be fastened in the pool below the dam al an angle not exceeding ex-ceeding thirty-five degrees. Inside of this box, fastened at the bottom, and at one end to the side of the box, there must be pieces of , plank four feet apart, placed transversely trans-versely so as to cause a rifile not less than ten inches high. There pieces ;of plank must be thirty inches long and so fastened as to be at right; angles with the sides of the box, alternately al-ternately fastened, one at one side, the other at tbe other side of the box. ; Whenever tbe stream is small, the county court of the county in which the dam is, or is to be constructed, may permit the box to be made of less dimensions, the court Uking good care to have a suitable passage. |
