Show Tiltlcn's Income Thx Suit. New York, 22. In the suit of the government against Samuel J. Tilden to recover $iDU,uuu ix an iua mtuiuti, the defendant, through his attorneys, has prepared an answer, which will be filed in a day or two. In substance sub-stance the answer is a general denial ol tho allegations in the complaint. The defendant eays he received no such income as the government asserts, as-serts, and deniea that ho failed to pay the whole amount of tax due. For two years he made returns of the amount of hia income upon which the assessed tax was paid, and the government gov-ernment having accepted such payment pay-ment such action was conclusive on the part of tho government for the other years when ho neglected tc make returns, aud tho assessor upon such information as he could obtain fixed the amount of income upon which a tax with tho penalty added was paid. The acceptance of such payment tho defendant claims was also conclusive on part of the government govern-ment nnd barred it from any lurther claim. 'Jildcu will demur to the first couut in the complaint, which seta forth the amount of his income on January 1st, '62, on tho ground that the act T congress covering that period wag jjfpealed before it went I into efiect'"' |
