Show THE 01MIIR KILLING. UselesB luoronae of thu CoBt Bill. The Froiiupnay of Homicides aud ihe lufremnncj uf Hangings. OlUUR, TOOELE COUNTV, February 15tb, 1873. Editors llerald: The examination of the oase of Tbe People Marovllui U.ilei, which watioointDtmcttd at Stuck tou on Salur day lait, was roncludtd yetierday about 8 o'clock p.m. The defendant was discharged. The testimony on the part of the prosecution was amply sufficient to warrant his dichargr, which wns evidenced by the fact thai1 the counsel for do (once bastd h id plea for the same entirely on that evidence, evi-dence, and yt theuaas was Ojuiinutd day after day t3 examine witnresei who agreed in tbe main points with those on tbe part of the prosecution, with no other result than the acou mutation of a larut bill of costs, which the people of Tooele county must pay. Toe testimony ol the lour men present at the tims of the killing made a clear case of self-defence. One witness for the prosecution testified testi-fied that Ocodwia tired the first two shots. A few thoughts on tbe frequency of killing, aud ol tbe iuvariabl plea ol self-defence, may not be amiss in this connection. It is a fact that the killing of a human being for the most trilling offence is quite common, and a plea of self deleuce is set up, and for some cause or other convictions are very seldeiu. Now it would be a very serious matter to condemu an innocent person, and it is very dangerous to turn criminals loose on the community. The law is a dead letter when it is not properly administered. Officers who neglect neg-lect to enfoice the law should be punished, and priv'e individuals in-dividuals who tuktt the law in their own hands, when a leya remedy ia provided, should be called to account for the assumption. For instance Jshn Smith said to John; Jones, "you are a nuns tnitl," John Jones said, "you are a God d d liar and I will kill you," the quairel goes on; they carry revolvers for each other; alter a while one of the parties is killed, aud the other makes a plea el self defence. In the first place, if John Jones is a horse thief, John Smith should take legal measures to bring him to justice; in the second place, if lie is not; the law provides for him a remedy in an action for slander. Oursociety needs remodeling, and if something is not done to bring Ui to a higher slate ol civilization, the cup of our iniquity will soon be over flowing. Advocate of Good O&der. |
