The bill is not materially changed from its original form, ai;d provides that in any prosecution prose-cution for polygamy where the defendant de-fendant is a believer in any religious system or sect among whom marriages mar-riages are not celebrated publicly, it shall not be necessary to obtain the evidence of any oyo witness to establish estab-lish such marriage, but evidonco of hatiitual recogmtiou by the defendant of his or her wife or husband, aud mutual recognition of tho child or children as their own, shall be deemed euilicient and competent evidence evi-dence upon which the jury may find Him fact of marriage. The bill allows the president to grant amnesty to those who have committed polygamy before December 9th, 1S78, and pro vide-a that those who acknowldge belie! be-lie! iu the Mormon raligion or themselves them-selves practice polygamy, shall not be eligible to BCrve as jurymeu in ihe trial of these cases. |
