Hardwick, indicted for forgery ; trial by jury. After hearing the evidence the court instructed the jury that the crime of forgery h id mt Iji.mii proven against the defendant, and that thoy could not find him guilty. Tho jury retired, and soon thereafter reported that in their opinion there was a conflict con-flict between the law and evidence, and asked lo be excused from further consideration of the case. Tbe court refused to discharge the jury and and si nt them hack to their room, when thwy inmiediAh-ly returned and reported a verdict against the deleiuiant of guilty as charged in the indictment. Tho court sharply Uvlured the jurors on their conduct, and discharged them.
