Show lr. Spinney. I'rie further examination of Dr. : Spinney was uot conliuued last evening even-ing as expected. The court had convened and everything was in readiness for a continuance of the hearing, but the lady witness failed to put in an appearance. At about S.20, Judge Snow requested a continuance con-tinuance of tbe dee until Thursday evening. The defense opposed this, and claimed that the examination should be proceeded with, or the defendant should be discharged on his own recognizance, at least. Tbe prosecuting attorney stated that he could not account for the absence of tbe witness, and thought it would be too lte to issue an attachment for ber last night, and Judge Pyper de cided that the case should be continued con-tinued until this afternoon at 4 o'clock. The defendant's attorneys then requested that their client be released on a bail of $500 paid down, which Judge Pyper allowed, in view of tbe unaccountable absence of the prosecuting witness. The amount was paid over fand Dr. Spinney was released till 4 o'clock this afternoon. Writa of attachment at-tachment were ordered issued for the appearance of the witnesses. - A few minutes after the adjournment adjourn-ment and dispersing of tbe crowd, tbe witness and her buBband appeared ap-peared in court and gave as their reason for the delay that they had . come as scon as they could, the lady I having a family to care for, and not thinking she would be required before the hour she was called for last evening. even-ing.
