Show Discharged from Custody. Yesterday morning Chief of Police Burt and policemon Phillips and A. Smith, appeared before U. S. Commissioner Com-missioner Toohy for examination on the charge of preventing one Album from voting on Monday. Messrs. Snow and Sutherland were the attorneys attor-neys for the defence, and U. S. Dis-trict-Atlorncy Carey and Judge J. R. McBride prosecuted. H will be remembered that Album was arrested by the police on election day for disturbing dis-turbing tho peace, profane swearing and striking an orliccr. At the exam ination yesterday the defense introduced intro-duced no evidence whatever, the witnesses for the prosecution clearly establishing the fact that the complainant com-plainant had broken the peace, and whs liable to arrest. The Commissioner Commis-sioner held that the police did their duty in taking All mm into custodv, and consequently discharged the delcnd.i n tj. The eiamiuatiou of Justice Clinton and the policemen under bonds on a charge of interfering with a U. S. Deputy Marshal in tho discharge of his duty, was postponed till next Tuesday morning.
