Guiding ami others, oth-ers, representing that tho water has overflown the ditch on Wot Temple street, v between North Temple ami First North streets, was referred to the water master. Petition of some of the residents of tho western part of the city, representing repre-senting that dead carcasses and Itlth are being deposited on Second South street, between Second and Third West streets, was referral lo the city marshal. mar-shal. " Petition of E. D. Hoge, asking the use of ten feet of the sidewalk and thirty feet of tho street in front of his premises on which to deposit building material, was granted. Petition of Walker Brothers, representing repre-senting that their present powder magaano was too small for present use, and asking the privilege of building build-ing a larger one, was grantal, and the chairman of the committee on public grounds was. authorized to locale lo-cale the site for the same. Petition of T. W. .Haskins, asking the council to pay to him tho amount of money expended by him in grading grad-ing the sidewalk on Walnut' t-lreet, said grading having been caused by irrigating d itched running across the street, was referral to the committee on streets a nil alleys. " Petition of the lire department, asking an appropriation of money to assist, the department in celebrating the Fourth of July, was referred to die committee on ways and means. Nine petitions, signal by 2,78'i citizens, citi-zens, asking the council not U) license any dram or tippling shops, and, so far as lies in their power, to prohibit the salo of liquors in the city, except lor medicinal purposes, was read, and a motion made to refer it to the committee com-mittee on municipal laws. City Attorney Hoge, being present, was as kit I to give his views on the subject. He statal that he had Iwen defeatal in all of his attempts to have the present ordinance sustained by the district judges, and he bad every evidence to believe that, should the questions in vol veil be appealed to the Supremo Court of the Territory, the ordinance would be held to be void; and a case of sullicient magnitude could not be made to carry it to the Supremo Court of the Unital States. He had thoroughly examined the city charter, and was of the opinion that the council had not the power to prohibit pro-hibit the sale of liquor; but probable-it probable-it could limit the number of licenses, lie then ollcrcil some suggestions for the attention of the council in draft- tions were as follows: Tho parties applying for license should be required re-quired to give their full names; reduce re-duce the license to $loU per quarter; the Mayor to have the power to close the saloons by proclamation whenever when-ever the safelv of the city demanded it, and on hufidays which were to be named in the ordinance; the saloons to be closed from 7 p.m. to ( a.m. of week days and all day Sundays. , Alderman Miner was in favor of laying the petition on the table. He, also had cxaminal the charter, and did not think the council had the power to prohibit liquor selling or limit the number of licenses. The Mayor thought the city had the right to limit the number of licenses li-censes or prohibit the sale entirely; did not expect to make an ordinance that would be sustained by biased, prejudiced judges. It was a right given to all cities lo control the liquor trallic; and the council bad only endeavored en-deavored to restrain liquor selling by a high license. On motion of Councilor Grow the Mayor was instrnetal lo appoint a commit toe of live to examine the law, and ascertain if the council has tlu? power, under the charter, to pass a pruhil itory ordinance. Muasrs. Miner, Mclvcan. Groo, Winder and Smith were appointal as such committee, com-mittee, and they were instrnetal to report at the next meeting. The committee to whom was referred re-ferred the petition of Kimball it Lawrence Law-rence and others, asking that Keese tfc Co. be restricted from storing more than 200 gallons of burning oils on their premises at any one time, re-portal re-portal adversely to granting the, prayer pray-er thereof, anil recommended that the alxve firm bo allowed to store any quantity of said oils on their premises, provided they keep it in a close, cellar, well covered with earth, and the entrances to such cellar U be of brick, with iron doors. The report was rcceival, and laid on the table. The Auditor's quarterly report for the quarter ending May Ml, was read and referral to the committee on finance. Bills of the Utah Job office and the Deseret Xf.ta office, for printing, were referral to the committee on claims. The council adjourned to Tuesday, the L'lst, at 7 o'clock p. in. |
