John Sbean was up fur preliminary examination; Major, Hemp-toad ar.d Mr. Fitch appearing for the People, and Mr. Royal lor dependent. de-pendent. The evidence went to show that on lue.-day, May 30th, Chas. Thompson and D. O. Rideout were; working on a claim on Lion Hill, in, Ophir mining district, Tooele County, when John Shean and a man named ( Ueese approached them; and, after en-J .piiring with an oath what they were Juing there, Sbean struck Thompson a heavy blow on the right side of the face with a hickory sledge-hammer ; handle or pick handle, which he had in his hand, Thompson being at the time using a pick in the hole. The blow is supposed to have stunned him, as he fell forward into the hole. Shean dragged him out with his right hand and struck him several blows with his left fit, severely bruising his face, although the man was senseless and Shean having to hold him up to strike him. Shean then turned upoji Mr.. Hideout and threatened him with personal per-sonal violence also; but the latter, thinking "discretion better than valor," left a little hurriedly, and so escaped. The evidence of Dr. Smith went to .-how that, though Thompson was severely se-verely bruised, his jaw be ng fractured and several teeth loosened, and hem-morale hem-morale of the lungs having ensued, his injuries were not of a character to necessarily produce death. Judge McKean and the lawyers went to the residence of Thompson to take bia te-tiuiony, as ho was suffering too severely from his injuries to admit of bis attending the examination.
