The principal point argued before be-fore the court by prisoner's counsel, was that the jury bench was incompetent. incompet-ent. This was decided in favor of the people. Judgment is reversed because the court below erred in admitting evidence as to the character of the defendant for chastity; and upon the further ground that in capital cases the defendaut is entitled to two councilors, coun-cilors, and that the attorneys must present the case to the jury alternately, arid in this instance the late Mr. Cook was entitled to t lie c'osiri argument to the jury which right was denied by the court.
