Parley L Williams attorney for the Oregon Short Line defendant in the damage suit of William W Croco sprung an objection to the jury as im panelled on the ground that the entire jury panel for the year was not legally drawn and certified to The law pro J vides that the assessor and clerk snail < at the beginning of the year prepare the list of names for the jury box and certify to the list Now in January of last year Moroni Brown assessor was in Arizona and the list was prepared by Clerk Farr and James Taylor deputy dep-uty assessor Mr Williams contended that the law specifically provided that the assessor was the party to make such drawing and that the deputys acts were Illegal In that connection A still stronger objection was urged that Mr Taylor had not signed the list even as deputy and the same was certified cer-tified to only by the clerk The point was argued and in the afternoon the judge overruled the point on the sole ground that Mr Williams objection was raised too late In the case The objection should have been j raisfed at the beginning of the case not after the jury was completed The suit is one of several growing out of the accident at Malad bridge in May last and Is for J25250 As two similar suits are to follow it is probable prob-able that the defense will work the point for as much as it Is worth ansi it is possible that the cases may have to KO
