Show WHO ART ZONEBS Attorney General Benders a Important portant Decision An opinion was delivered by the at torneygeneral yesterday which is of interest to mining men I was called I for by a letter from A J McCulston county attorney of Tooele who asked I the meaning of the words bona fide miners residing in any mining district dis-trict as used in section 12 of the act 1 I I In reply Benner X Smith the deputy i attorneygeneral says in his opinion i bona fide mining men are those who I follow the business of mining and are actually engaged therein and have an j actual residence in any mining district I A miner says the learned attorney a defined by the supreme court of Colorado I Colo-rado is one who mints a digger for metals and other minerals j The county attorney of Tooele having hav-ing been satisfied on that point the tt j for attorneygeneral answers another question relative to justices of the i peace in connection with the subject j as to whethe they have jurisdiction over offenses specified in chapter 3G of i the mining code The law says that 4 any district mining recorder who fails i to deposit the books or records of the recors j 4 district with the county recorder in I i which the district is sifuaied within j I 20 days after the passage of the act I shall be deemed guilty of a misdemeanor misde-meanor I I Justices having jurisdiction in cases of misdemeanor where the fine is not over 300 or imprisonment in the city o county jail for not to exceed six months or by both the attorneygen eral is of the opinion that justices do have jurisdiction in these matters i Several authorities are quoted in support sup-port of this theory and among these is the celebrated cause of the People vs Reggel in the eighth Utah where the ccurt held that the word not in the clause reading not less than I I S200 should be left out |
