| Show vMUSSER DISCHARGED DISC11ARGEDr There Was no Evidence Against Him in the McCart Cases Case-s EIOTIXG T TH COKE REGIONS The Women Fought Like Timers Aprainst I Eviction The Portuguese Fire on a British 1 Steamer in South Africa MONTPELIER Idaho April 20Special telegram to THE HERALD The preliminary prelimin-ary examination of Dr E E Rivers and A 11 Musser for the murder of S B Mc I Cart was concluded here last night before 1 Judge Keiley Twentyfive witnesses were examined for the prosecution and on Saturday Satur-day afternoon the prosecution rested their case The defense only put five witnesses oa the stand The evidence showed that E E Rivers and A M Musser and others went into the Arcade hotel and there was a notice placed on the table that one of the tables was reserved for S B Mc Cart and family Rivers took the notice from tho table and put it in the stove andiq J was burned up and they sat at the table McCart went into the dining room after having been informed that the notice was put into the stove and iccused Rivers of doing it Rivers denied ue accusation unamovea so the next LULUU A hen McCart picked up a chair and struck Rivers und called him vie names McCart again struck Rivers with the chair when Rivers pulled out a pistol and shot McCart in the leg McCart again picked up a chair and went after Rivers the third time when 4 Rivers fired the fatal shot and killed him instantly The attorneys for Rivers made a plea for self defense The court at 9 oclock last night held Rivers under bonds of 52500 to await the action of the grand jury which will meet in October A M Musser jr was discharged as there was no evidence to show that there was a conspiracy between Musser and Rivers t take the life of Mc Cart C The examination lasted from Wednesday until Sunnay evening night sessions being inorder but the attorneys on both sides agreed continue the examination without adjournment hence the court was held on Sunday and the arguments of the attorneys attor-neys and the verdict of the court were rendered on the Sabbath day Considerable feeling is expressed in regard re-gard to the low bonds Rivers Is held under Sheriff Jones leaves with the prisoner for J the county jail this evening as he has not 4 been able to furnish bonds so far The Reeling between Rivers and McCart has grown out of Rivers trying to elope with McCarts stepdaughter Never in the history his-tory of this county has so much interest teen taken by the citizens a in this triaL |
