| Show nlR J1OiA1U1AS A LAlY He Was Also Shiftless and an Actor Artist A DIVORCE WAS GRANTED Mrs Hammoml Wants a Greater Share I of household Effects Sue Goes Into Details Concerning FeatherBed Feather-Bed Quilts rigs and Other things A Kecelrer Appointed for a Milling Company Annie Leotard was granted a decree of divorce from Leon Eugene Leotard on the I ground of desertion and failure to support sup-port Mrs Leotard stated on the stand hat she was married to the defendant in 874 and that he had failed to support her for the past three years He was in the habit leaving her for months at a time and he finally left her for good He also treated her cruelly and charged her with being unfaithful to him In answer to a question propounded by the court Mrs Leotard stated that her husband was an artist and actor but > was worthless shiftless and lazy Upon corroborative evidence being given the decree was granted and the plaintiff I awarded the custody 01 three children ngedflfteen years three years and five I months respectively I WAXTS THE FEATHER BED Mrs Hammond Thinks Uer Husband Got the Best of the Division A motion to modify the terms of the decree entered some time ago in the divorce case of Mary Ann Hammond vs William Hammond was called up by Colonel Miller for the plaintiff and J W Bowman for the defendant before Judge Zane yesterday morning Colonel Miller presented the following affidavit made by > the plaintiff in the case The affiant Mary Ann Hammond be ng first duly sworn on her oath says That among the household goods belonging belong-ing to the above action there is only one feather bed and four feather pillows that the bed she procured by saving feathers and buyinc the material from her own personal earnings that there are only three sheets all told that there are only two pieces of blankets which she bought last fall on credit from her sisterinlaw and they aro not yet paid for that she has only five quilts all told and they with the exception of one are badly worn that she has no pillowcases pillow-cases except half a dozen sugar sacks that all the other beds in the house are made of factory cloth tined with straw that the remainder of the household furniture a few old chairs and tables one old cook stove with a few cooking utensils and for a wash boiler she uses an oil can that she has an organ which she bought on time and yet owes 2310 on it that if the order of the court is to be carried into effect touching touch-ing the bed and bedding it will leave her without a bed for herself and children that there is only one fresh milk cow which the defendant has taken together with all the other stock on the place except ex-cept the two small pigs and the horses that one of tho two large pigs which defendant has taken is a brood sow which defendant bought of her earnings about two years ago for the purpose of breeding that there were only three head of horses all told and one is a yearling colt that one of them a mare and the colt belongs to one of the children having been bought out of the stray pen by the affiant and given to him about one year ago that the I mare and a small horse are the only ones of the three fit for work that there is only one plow one mower and one reaper except a little hand plow and it has one handle broken off that the mower is damaged and needs repair thai I therewere two sewing machines one belonged be-longed to the plaintiff and the defendant traded it for a new one that her son Em mitt took away from the house three quilts and a blanket and has them yet The affiant is wholly without means except as stated in this affidavit and the land set forth in the proceedings for division If the division of property be allowed to stand as made she will be rendered unable to do anything to make a living for her children except by living out to do manual labor that the defendant defend-ant is now living with their son etc Mr Bowman insisted that the property had been equally divided and filed affidavits affi-davits to that effect Colonel Miller made a gallant fight for the feather bed and Judge Zane then took the matter under advisement The hearing was very amusing |
