business in a remarkably short time The meeting was notable for the unity of action and Rood feeling that prevailed President Nelson presided and all members were present except ex-cept Pike Sirs Kittar Homes Casady of Salt Lake and CM Lockwood of Chase Kan applied ap-plied for positions as teachers Referred to the committee on teachers and schoolwork school-work George Weggland and Mrs Mary Conroy applied for positions as janitor Referred to the committee on furniture and supplies COMPLAINTS OF TUB BUILDERS The committee on sites and buildings reported as follows Your committee on sites and buildings build-ings to whom was referred the communications communi-cations of II W Redfield and the Builders I Build-ers and Trades exchange both in regard to the Oquirrh school begs to report that the board has advertised for and received bids fr each class of work separately and in tho aggregate and believe that the course pursued has been in accordance with law Your committee have directed the superintendent to make the necessary excavation for the foundation and when completed will report to this board The experience of the board with the foundations of the Jackson Jack-son Franklin and Sumner school building demonstrates that owing to the uncertain character of the soil in Many parts of the city It is impossible to determine the extent of the foundation required until excavation is made and believe that this course will be more economical and be productive of better results than if included in the general contract In the opinion of your committee the course pursued is dictated by ordinary prudence The published report of the treasurer i shows the financial condition of the board Your committee is of the opinion that this contract should not be awarded until the matter of the issuo of bonds required re-quired for the erection of the Oquirrh and other school uildings requisite to complete com-plete the system originally intended to supply all portions of the city with proper school facilities be first submitted to the people The communications have been referred re-ferred to the attorney of the board whose opinion is hereto annexed and made apart a-part of this report THE BOARD MAY BUILD The attorneys report was as follows II Referring to your letter of this date relative to the Oquirrh school building t and the question whether or not the board is right under the circumstances stated to proceed with the work of putting put-ting in a foundation I have to advise you i that I had upon noticing the action of the 1 Builders and Traders exchange as reported re-ported in the newspaper looked at the statute The strict letter of the law might be construed to require the board to continue advertising for bids until bids are satisfactory Adherance to that view of the law might result in requiring i an ualimited number of repeated and unavailing I un-availing invitations for bids and prevent indefinitely the construction of the school houe I incline to the opinion that the statute is to be considered as directory I have not had time to examine in the light of authority on this question but would hardly expect to find any decisions in such a case While in doubt I am inclined in-clined to advise that the action the board i has taken is legal and ought to be pursued pur-sued for in such a case if there was doubt I would advise that that doubt be resolved in favor of the right of the board to net as it has attempted In other words it seems to me that you ought to have an opportunity to build the schoolhouse school-house or any portion of it independent ofT of-T the contractors if you cannot get a satisfactory satis-factory bid and to concede the proposition proposi-tion that the board has not that right would put it into tho hands of contractors contrac-tors by combination to prevent the construction con-struction of the schoolhouse for a reasonable reason-able sum I return herewith papers accompanying ac-companying letter Filed ECONOMY IN INSURANCE The committee on sites and buildings recommended that the insurance of 10 000 ordered placed temporarily on the Washington school be increased to three years as in placing the insurance for one year the board has to pay a premium of half as much as it would for a period of three years and when the building is completed the insurance can ba transferred l trans-ferred to other nchool buildings r Adopted BONDS FOR HEATING CONTRACTS The same committee repqrted that the form ol contract heretofore adopted required re-quired no bonds from the contractor for Bteam heating hence there had been no guaranty that the work would be commenced com-menced nnd no bond that the plant would be acceptable the only I guaranty being that it was satisfactory in its workings at the trial to I which the plants were subjected by the board Hence the committee recommended recom-mended that a boud be required and that heating contractors be paid as the work progresses on the certificates of the superintendent su-perintendent in the usual manner and this rule be applied to the contract for heating and ventilating the Jackson school building dTIm THE WRIGHT CONTRACT The attorney the board reported upon a report of the finance committee which had been referred to him The committee commit-tee Teport recommended that no further payment be made to F M Wright contractor con-tractor for the Washington school nor to his bondsmen as long as there are any filed liens against the building or garnishments gar-nishments existingagainstthe contractor The attorney stated that he did not think the adoption of the report would invalidate the contract but instead was in harmony with the same With reference refer-ence to a writ of attachment served on the board in the case of Peter L Hanson vs Klambeck Parsons et al he thought t k it was operative He was also of theM f the-M opinion that liens filed would operate to injure in the hands of the board any ret I re-t sources due to the principal rand r-and that in cao such liens were filed no further payment should be made to the J contractor until such liens are discharged Jr1 or released or until the parties should lid interplead and have their rights adjudicated adjudi-cated i Referred to committee on sites and buildings The committee on teachers and schoolwork school-work recommended that the superintendent superin-tendent of schools be authorized to have printed 10000 cards of notification to children of their classification in the schools at the beginning of the next < school year and that he also be 111893 To the Honorable Board of Education GEXTiiEaiEN Your committee on finance to whom was referred report No 32 of the committee on sites and buildings dated April 13 1893 begs to report that they have the same under consideration and recommend that the following resolution reso-lution to provide funds to supply the needs mentioned therein be adopted Whereas It Is in the judgment of the board of education or the city of Salt Lake advisable to issue and negotiate bonds for school purposes pur-poses as hereinafter stated Now therefore Be it ordered and resolved by the said board of education that an election Is hereby called In each of the municipal wards of the said city of Salt Lake to be held on the 5th dayof June 1893 to submit to the legal voters of Salt Lake City school district whether 5 per cent twenty year bonds of the said district 1 dis-trict shall be Issued to the amount of 225000 for the purposo of raising money for purchasing school sites for building or purchasing one or more school houses and supplying the same with furniture necessary apparatus and improving Im-proving the grounds and for liquidating the indebtedness In-debtedness already Incurred for such g9t ciass rooms heating and ventilating same architects archi-tects services new furniture and apparatus and making and improving improv-ing grounds It Is easy to be seen why we are short of funds to meet amounts to become duo on existing ex-isting contracts and why it Is necessary to ask I the voters of Salt Lako city school district for additional bonds The valuation of all taxable property as per county tax roll within the district for 1892 was 11358 000 2 per cent of this sum the limit to which said district may be bonded would be n 827160 00 And having already issued in bonds 603000 00 leaves but 5207160 00 Or in round numbers 225000 thai wo can ask tho people to vote but this sum would enable en-able us to meet the deficit above shown and provide three or more additional school houses in localities greatly in need or them UNANIMOUSLY ADOPTED The resolution was adopted by a unanimous unani-mous vote Baldwin moved that the officers of the board be authorized to give the election notices and take such other steps as are necessary to carry out the resolution calling call-ing the bond election Carried Young moved that the finance committee commit-tee be requested to prepare the address contemplated in the resolution and report at the next meeting of the board Carried Adjourned for one week I |
