Show A Robbers Record John Smith the convict who has been serving a ten years term at the penitentiary peniten-tiary for robbery and who claims that if he had been given the benefit of the new copper to which he is entitled his term would have expired in July last was brought down to the city again yesterday morning and was taken before Judge Anderson who sent the prisoner pris-oner to Judge Zane The latter sent him to Commissioner Greenman as a proper person to hear the application and Smith made his statement beiore him Commissioner Greenman quoted the following follow-ing section of the compiled laws bearing on the subject For a violation of the rules the convict shall be liable to forfeit all his reduction time for the month in which the infraction occurs If the offense or offenses be aggravated or frequent the warden or other officer In charge shall have power to punish the offender by depriving him of all or any portion of his reduction time earned previous to the commlslon of said offense or offenses Provided that any convict who may feel himself aggrieved by the action of the warden or other officer In charge in such cases shall have the right to appeal in writing to the governor of the territory which writing shall include a statement of facts and the evidence evi-dence and reasons of tho appellant for considering consider-ing him elf unjustly dealt with Should the governor upon investigation deem the complaint of the convict well grounded he shall have power to credit back to the said co vict the earned reduction time of which he has been deprived Warden Yandercook then sprang the following fol-lowing record to justify his action in detaining de-taining Smith Received at penitentiary Septembers 18S3 Sent to insane asylum May 23 ibS4 Returned to penitentiary July 6 1831 Conduct in November 1881 very bad February 26 1886 sentenced by the Third district court to nine years in the penitentiary February 231885 escaped while on the way to the penitentiary March l 18S6 returned to the penitentiary a reward of 5100 having been paid lor him September 6 1E89 lost five days for fighting October 27 1890 ditto I June 18 1801 stabbed a prisoner named Jones This was a pretty tough record but It didnt phase Smith a bit He went right on talking and claimed that he was justified in stabbing the man Assistant United States Attorney Stephens claimed that the commissioner had no jurisdiction over the matter and contended that only the governor could act Commissioner Greenrnann took the same view of the cane and Smith returned the penitentiary |
