Show SECOND DISTRICT COURT Business Transacted Before Judge Anderson at Beaver Yesterday BCAVEK Utah March 13 Special telegram tele-gram to THE HcnvLDIn the Second dis ttict court today the case of Hans P Iver son charged with adultery and unlawful I cohabitation was called and a jury was empanelled onthe firstnamed charge The court asked the defendant if he had an attorney at-torney to which the response came that ho had not He was then asked if he was ready to proceed to trial and answered that he was The court asked if he did not want to have an attorney He said he did rot and was asked if he understood the nature na-ture of the crime of adultery and the punishment pun-ishment that might be passed upon him should he be found guilty He did not exactly ex-actly understand and the court instructed him and asked him again if ho wanted an attorney He said no ho did not he believed be-lieved that tho jury was composed of gentlemen and that the court would see that lie had a fair trial and not convict him unless he was guilty He further stated that he thought he had been indicted for unlawful cohabitation cohabi-tation and wished to plead guilty to that charge Assistant District Attorney Zane proposed that the plea of guilty be taken and the charge of adultery dropped The court said as the man appeared to be a good citizen and had never before been be i fore the courts hence he did not appear to understand the nature of tho offense that plea might be taken and tho other charge dropped as proposed by the attorney Mr Iveron was then allowed to plead as staced which ho did and the time of sentence sen-tence was fixed for Saturday morning at S oclock The charge of adultery was accordingly ac-cordingly dropped and the accused left the room a happy man At 2 pm the court convened after a three and a half hours recess and the case of Peter Pitts accused of grand larceny was called A jury was empanelled and the trial proceeded with John M Zane prosecuting and William McCarty defending defend-ing The prosecution produced testimony by four witnesses The defense moved that the jury be instructed to return a verdict of not guilty which was overruled The defense rested Tho case was argued and given to the jury who came in at 740 i and asked for instructions from the court Court will probably last until the middle of next week as casesaro set for the 19th |
