Show THE PROMISED LAND The Secretary Noble Tells Al About I THE MEXICAN LAND GRANTS The Snprcme Court Decides Somo Importan S Points About Them The California I Courts Reversed WASHINGTON April 1The commissioner of the general laud office with the approval of Secretary Noble has issued t registers and receivers of the newly established land offices in Olahoma a leticrjf instructions oi speial interest to persons desiring to settle in that territory The most important features fea-tures of the letter arc the following except that reserve lands are made subject to entry by actual settlers under the homestead home-stead law with certain modifications Attention is dircctad to the general circular circu-lar of January ISSJ containing tlur homestead home-stead laws and official regulations there under These laws and regulations are modi fled by thc special provisions of lar h 2 e in the tolowing particular viz the rule 1 as slated under the title br which only one homestead privilege to the bal person is permitted is so modified as to admit of homestead entry being made by mn one who prior to the passage of the act had made a homestead home-stead enl but failed from any cause t secure title in fee to the land embraced therein or who having secured such title did so by what is kown as commutation of hoaipstead entry With regard t persons making homestead entry and failing to S acquire title thereunder or commuting thum after the passage of said act of March 2 ISSJ the rule as t second homesteads is operative and will be enforced in relation t these laws as well as others The statute provides for the disposal these lands to actual settlers under the homestead law only and while providing that all rights of honorably discharge union soldiers and sailors in the late civil war shall not be abridged makes no men tIn of those sections under which such sold rs and sailors their widows and orphan children are permitted with re gird to the public land generally to g1 make additional entries gin iertaii eases free from the requirement of actual setUeuiint on the entered tract I is therefore held that soldiers or sailors additional entries cannot be made on those lands under said section unless the party claiming will in addition to tJy proof required make aflidavit that the itry is made for actual settlement and cultivation Entries will not be subject to commutation under section 230 R S Any person applying to enter or file for home tail will be required first to make affi davit in addition to the other requirements that he did not violate the law by entering upon and occupying any portion of the lauds prior to April 22 onsite entries may be allowed but limits the area in any such entry to onehalf section or B20 acre as the maximum whatever the number of inhabitants |
